In his introductory brief, the EAC general prosecutor targets the former president of Chad and five high level civil servants during his regime. After the investigative phase, Hissein Habré only is indicted and sent to trial.

Habré, who will be 72 in 2014, is the third President of the Republic of Chad. Member of the rebel movement Frolinat in the 1970s, he became prime minister for a short period, and then head of the Armed Forces of the North (FAN). Once at the helm of those forces, he carried out a coup against his predecessor, Goukouni Oueddeï, on June 7, 1982. Habré was in turn overthrown by General Idriss Déby on December 1, 1990. Senegal granted him political asylum.

On January 26t, 1983 President Habré created the Directorate of Documentation and Security (DDS) by decree. This intelligence agency was accused in 1992 of acting as a tool of political repression responsible for disappearances and torture by a national commission of enquiry in Chad. The link between the former Chadian president and DDS is at the centre of the case opened by the African Extraordinary Chambers (EAC), who charged him on July 3, 2013, ordering his provisional detention in a specially designed prison cell in Cape Manuel of Dakar.

On February 13, 2015, the investigative chamber finds that it has sufficient evidence against Hissein Habre to indict him and send him to trial for crimes against humanity, war crimes and torture. On July 20, 2015, his trial opens in Dakar, before the Extraordinary African Chamber of assises.

Director of DDS

Guihini Qurie is the second director of the Directorate of Documentation and Security (DDS), where he worked from 1987 to 1989. Political refugee in Togo, he was kidnapped in May 2013. He is wanted by both the Chadian judicial authorities and the CAE, who issued an international arrest warrant against him.

According to the EAC investigations chamber, “there is sufficient evidence that during the period between 1982 and 1990, Guihini Koreï, Abakar Torbo, Mahamat Djibrine aka El Djonto, Saleh Younouss and Hissein Habré formed a joint criminal enterprise in furtherance of which they committed crimes against humanity”.

At large in an unknown location, Guihini KoreĂŻ could not be arrested.

Saleh Younouss : Director of DDS

Director of DDS

Saleh Younouss is the first director of the Directorate of Documentation and Security (DDS), where he worked from 1983 to 1987. Charged with complicity in murder and torture, he was arrested in July 2013 by Chadian judicial authorities. He is also targeted to in the proceedings brought by African Extraordinary Chambers (CAE), which issued an international arrest warrant against him.

According to the EAC investigations chamber, “there is sufficient evidence that during the period between 1982 and 1990, Guihini Koreï, Abakar Torbo, Mahamat Djibrine aka El Djonto, Saleh Younouss and Hissein Habré formed a joint criminal enterprise in furtherance of which they committed crimes against humanity”.

Chadian authorities declined the EAC request for transfer of Saleh Younouss. The first director of the DDS has being tried before the criminal court of N’Djamena with twenty-three other individuals, and sentenced to life imprisonment on March 25, 2015.

Manager of a prison

Abakar Torbo was a prison manager from 1985 to 1990. He is believed to have been a member of the commission in charge of punishing members of the Zaghawa ethnic group (1989) during this period. A refugee in Cameroon, he is allegedly on the run, sought by the Chadian judicial authorities and the CAE, who have issued an international arrest warrant against him.

According to the EAC investigations chamber, “there is sufficient evidence that during the period between 1982 and 1990, Guihini Koreï, Abakar Torbo, Mahamat Djibrine aka El Djonto, Saleh Younouss and Hissein Habré formed a joint criminal enterprise in furtherance of which they committed crimes against humanity”.

At large in an unknown location, Abakar Torbo could not be arrested.

Mahamat Djibrine a.k.a “El Djonto” : Coordinator of the DDS

Coordinator of the DDS

Mahamat Djibrine a.k.a. “El Djonto” is the coordinator of the directorate of documentation and security (DDS) and head of intelligence under President HabrĂ©. He was allegedly, at various point in times, part of commissions to punish members of Hadjarai (1987) and Zaghawa (1989) ethnic groups. Accused of war crimes and crimes against humanity, he was arrested in Chad in May 2013. He is also under a warrant issued by CAE.

According to the EAC investigations chamber, “there is sufficient evidence that during the period between 1982 and 1990, Guihini Koreï, Abakar Torbo, Mahamat Djibrine aka El Djonto, Saleh Younouss and Hissein Habré formed a joint criminal enterprise in furtherance of which they committed crimes against humanity”.

Zakaria Berdei : Special security adviser to the President of the Republic

Special security adviser to the President of the Republic

Zakaria Berdei was a special security adviser during the regime of President Habré. Currently under an international arrest warrant issued by the extraordinary African Chambers, he is allegedly in Chad.

Among the six suspects, only Zakaria Berdei was not charged by the EAC investigations chamber at the end of the investigative phase. He has not been prosecuted either by the criminal court of N’Djamena.
